Terms and Conditions of Service

1. Object and general information

We put at your disposal these terms and conditions (hereinafter, "General Conditions") that regulate access, use, navigation and, where applicable, registration in the web application located under the domain acutar.io and their respective subdomains, including also any mobile application (hereinafter, the "Web and Apps"), owned by Acutario.

From Acutario we reserve the right to extend, modify, replace and/or cancel our Service at any time and without prior notice, without this giving rise to liability or compensation. We will do our best to notify you of any modification that the General Conditions may suffer in the future. We will also update the "last update date" located at the beginning of these General Conditions. If you are a Registered User, we will notify you of any modification of the General Conditions by sending an email to the email address you provided during registration. However, we advise you to check frequently these General Conditions to be aware of any changes we can make. If you access the Web and Apps or use the service after any changes are made to the General Conditions, you will be expressly accepting the new General Conditions.

What is Acutario?

Our web application hosted under the acutar.io domain and its subdomains, contain a technological platform that we make available to our customers so they can manage the absences or sick leave of the staff within their organizations. Acutario does not intervene in the requests that are made within the platform. We are only a mere intermediary whose objective is to facilitate the request and acceptance of absence periods between workers and their employers. In this context, we offer some additional services related to our Service, such as integration with third parties and notifications through different means.

2. Access and Acceptance of the General Conditions

The access or use of the Web and Apps grants you the condition of User and it is assumed that you have read, understand and agree to comply without reservation with these General Conditions. In the event that you have registered a new organization on the platform, you will become a Customer and User simultaneously and also assume that you accept the General Conditions as well as the Particular Conditions.

The access and use of the Web and Apps is done under your sole and exclusive responsibility. If you do not agree with these General Conditions or with any modification that may be made of them, you must stop using the Web and Apps. If you continue to use them, you will be accepting the General Conditions.

3. Conditions of use and responsibility of the use of the Web and apps

The use you make of the Web and Apps must respect these General Conditions, the current law applicable in your country, morality and public order.

You can not make illicit or incorrect use or that contravenes any of the provisions of these General Conditions. Here is a list of what you can not do:

If you carry out any of these behaviors, you will be able to receive a claim for any damage that may arise as a consequence of the breach, direct or indirect, of these General Conditions. We reserve the right to cancel unilaterally and in our sole discretion and without prior notice, access, use, and / or registration to our Web and apps, without this giving rise to any compensation on our part.

Likewise, you agree to inform Acutario if you observe an unauthorized use of the Web and Apps, if you are aware that a violation of a right of Acutario or of third parties is taking place, or if it is being used contrary to these General Conditions.

4. Acutario Liability

Our responsibility is limited to the legally established by Spanish Law 34/202, of July 11th, about Services of the Information Society and Electronic Commerce "LSSI" which indicates in general that we can not be responsible for the information published to request of the Users.

Therefore, as providers of a mere intermediation service, we have no obligation to exercise prior control over the veracity and accuracy of the information published through the Web and Apps, since the information is stored at the request of Users.

Acutario will not assume any type of responsibility for damages or losses that could derive from the relationship between Users and Customers due to their contacts and negotiations of requests for absence.

Access to the Web and apps requires a device or computer equipment as well as an Internet connection. By these General Conditions, you acknowledge and accept that the expenses derived from the need of those elements will not be assumed by us under any circumstance.

5. Personal data protection

By accessing the Web and Apps and/or using the Additional Services and Services, we may treat your personal data as a User or Customer. You can obtain detailed information about the form and purpose for which we will treat your data by consulting our Privacy Policy.

We also inform you that we can use "cookies" when you browse the Website. You can obtain detailed information about our use of "cookies" by consulting the Cookies Policy.

6. Duration and termination

Access to the Web and Apps have an indefinite duration, unless otherwise provided in any section of these General Conditions or in the applicable legislation. However, at any time, both the Customer and the Acutario may terminate the relationship, without the need for prior notice.

Any clause of these General Conditions that is or becomes illegal, invalid or unenforceable will be excluded and will be considered inapplicable, being replaced by another that resembles as much as possible, without affecting or harming the User and/or Customer, and without giving rise to any compensation. In this case, the rest of the provisions or sections not affected will be fully valid.
